BYLAW ENFORCEMENT


There are several City Departments mandated to deal with By-law Enforcement in the city of Joburg.  They include: JMPD, Building Control, Land Use, Environmental-Health, and Displaced-Persons-Units. All work together in various and overlapping ways to deal with noise pollution, public drinking, vagrancy, illegal spaza shops and sidewalk vendors, illegal dumping, problem properties and more. The bylaws stipulate and implement the rules and regulations regarding the above to ensure that all residents in Auckland Park have quality of life. Residents wanting to make a difference in this area must Log/Report Complaints via the correct channels and get reference numbers for all.

If a property is under construction and has the necessary CoJ Permits these are the laws that guide hours of work.


Regulation F6 of National Building Regulations and Building Standards Act, 1977 (as amended 30.05.2008) states:


(2)(a) No person shall during the course of any building, demolition or excavation work use any machine, machinery, engine, apparatus, tool or contrivance, which in the opinion of the local authority may unreasonably disturb or interfere with the amenity (comfort, peace) of the neighbourhood:


(i)    on a public holiday or Sunday


(ii)    before 06:00 or after 17:00 on any Saturday; and


(iii)   before 06:00 or after 18:00 on any day other than those days contemplated in   subparagraphs (i) and (ii)


(b) The prohibition in paragraph (a) shall not apply in any circumstances in which the use of such machine, machinery, engine, apparatus, tool or contrivance –


(i)    is urgently necessary in order to preserve the life, safety or health of any person;


(ii)    is urgently necessary to preserve property;


(iii)   has been authorized by the local authority; or


(iv)   is necessary for the execution of work being carried out on behalf of any public authority.


(3) Any owner or person who contravenes a provision of this regulation shall be guilty of an offence.


If you believe that a builder or your neighbour is contravening these regulations, first speak to your neighbour or the builder. 

If you get no positive response, call JMPD (011 375 5911) or SAPS at 10111.

The department of Development Planning has initiated a series of Alternative Service Delivery Implementation Protocols to maintain the service delivery to our residents/ customers and stakeholders. 


Given the challenges the department and the City is experiencing, the department is striving to provide service with minimal disruption and delay to our residents and customers. 


A key component of the protocols is access to key personnel within the department. The department and the team below are committed to maintaining service delivery and ensuring the residents and customers can get access to information, services and guidance on development planning matters.

  1. Gather contact details regarding any  property-of-concern around you.
  2. Make contact with the residents, caretaker/manager or owner in a neighbourly-way
  3. Ask for their contact details and ask them if you may share the information with other neighbours for neigh

APRA Recommended Steps for responding to Noise Pollution & other CoJ Bylaw matters: 


  1. Gather contact details regarding any  property-of-concern around you.
  2. Make contact with the residents, caretaker/manager or owner in a neighbourly-way
  3. Ask for their contact details and ask them if you may share the information with other neighbours for neighbourly & security purposes 
  4. Also pass-along, with permission, the contact details of other neighbors. 
  5. This allows all to know that all will be accessible & somewhat accountable to each other as neighbours doing our best to live together in an area
  6. If a problem arises, FIRST make contact privately via phone message, or email.  Detail the date, time, length and nature of the problem and see if they will work with you to sort it out in amicable fashion.  We strongly recommend you approach the issue in  the way you would prefer to be approached. 
  7. SECONDLY Invite/request other neighbors on your street to make similar contact with them. Confirm if they were able to do so & if there was any positive response. 
  8. LASTLY Call 10177 OR 011 375 5911 for the bylaws Call Center (24/7/365)  Always get a reference# Ask to speak to a supervisor if unsatisfied.
  9. Please be sure to follow the steps listed above before you begin your contact with JMPD 
  10. For further info & assistance re bylaws call JPMD on  011 490 1630 OR  011 490 1576. 
  11. For disturbance of the peace call SAPS 011 248 5520/5521/5522. Get officers name and OB Reference Numbe
  12. Contact our security company partners (RAID, Beagle-Watch, Fidelity/ADT) who technically do not have a mandate or authority, but can usually assist in these situations.
  13. If you are a client, call your Security Company first then others to assist if needed.
  14. If it’s a non-neighbor-related situation like a Trading Stall then you go directly to step #8.
